Terms of service
The short version, in plain language.
These terms apply when you book a mobile notary appointment with us. They are deliberately short. If something here is unclear, email us before you book.
Effective 18 August 2026
Who you are dealing with
Evedens Notary is a division of Evedens Consulting Inc., a New York corporation. Appointments are performed by a notary public commissioned by the New York State Department of State, commission number 01EH0027540.
What a notary does, and does not do
A notary public verifies the identity of the person signing, confirms that they are signing willingly and appear to understand what they are signing, witnesses the signature, and applies a seal and journal entry.
A notary does not do any of the following, and neither do we:
- Give legal advice, or tell you which document you need
- Draft, complete, correct or review your documents
- Certify that a document is true, accurate, valid or enforceable
- Act as a witness where the document requires witnesses independent of the notary, unless we have agreed that in advance
Evedens Notary is not a law firm. Nothing on this site or said at an appointment is legal advice. If you need advice about a document, speak to a lawyer before you book.
Booking and payment
The visit fee is charged when you book, through Stripe. We never see or store your card details. Prices are the ones shown on this site at the time you book.
The visit fee covers travel, scheduling and our time. It is a private commercial charge and is not regulated.
The notarial act itself is separate. New York Executive Law § 136 caps it at $2 per signature. We charge exactly that, we collect it at the appointment, and it appears as its own line on your receipt. It is never folded into the visit fee.
Your booking is confirmed when payment clears, and a confirmation email is sent to the address you gave us at that moment. It states the date and time you selected, and that is when the notary attends. In the rare case that we cannot cover the time you chose, we will tell you as soon as we know and either agree another time with you or refund the visit fee in full. As a courtesy we usually also text the mobile number you booked with when the notary sets off, but email is the channel we commit to and the one you should rely on.
What you need to have ready
- An unsigned document. Do not sign before we arrive — the notary has to witness the signature, and a pre-signed document has to be reprinted.
- Valid, unexpired government photo identification for every person signing, showing a photograph and a signature.
- Every signer present in person at the appointment.
- Identification for any witnesses your document names.
- A complete document. We cannot notarize a document with blank spaces left to be filled in later.
When we will decline
A notary is required by law to refuse in certain situations, and we will, without exception:
- The signer's identity cannot be established to the notary's satisfaction
- The signer does not appear to understand what they are signing
- The signer appears to be acting under pressure from someone else
- The document is incomplete, or the signer is not the person named in it
- The notary has a personal interest in the transaction
If we decline for one of these reasons, we do not charge the $2 statutory fee, because no notarial act took place. How the visit fee is handled is set out in the refund policy.
Getting to you
We travel anywhere in the five boroughs and we attend at the time you booked. Traffic and building access are outside our control, so treat that time as the hour rather than the minute. If we are going to be materially late we will contact you on the email or the mobile number you booked with rather than leave you waiting.
You are responsible for telling us in advance about anything that affects access: a visitor policy at a hospital or facility, a doorman who needs to be notified, a gate code, a floor without an elevator. Tell us in the notes field when you book.
Records and privacy
New York requires a notary to keep a journal of notarial acts. We record the date, time, type of act, the name and address of each signer and the identification we relied on. We keep these records for the period the law requires and produce them only when a signer, a court or the Department of State is entitled to see them.
We collect your name, phone number, email address and the address of the appointment in order to schedule and perform it. We do not sell your information or use it for marketing. Payment information is handled entirely by Stripe and never reaches us.
Limits
Our responsibility for any appointment is limited to refunding what you paid us for it. We are not responsible for consequences that follow from a document being rejected, filed late, drafted incorrectly, or not doing what you expected it to do. Those are outside what a notary is permitted to advise on or control.
Nothing here limits any liability that cannot be limited by law, including liability arising from the notary's own misconduct in office.
Governing law
These terms are governed by the law of the State of New York. Any dispute belongs in the state or federal courts sitting in New York City.
Changes and contact
If we change these terms, the version in force for your appointment is the one published on the day you booked. Questions go to bookings@evedens.com. If you have already booked, replying to your confirmation email is faster, because it carries your appointment details with it.
